Terms and Conditions
- A Cruiser is booked only when the signed, completed Booking Form together with one-third of the total hiring fee as deposit has reached the Company and a receipt or acknowledgement of booking has been despatched to the Hirer. There is no booking fee; the deposit forms part payment of hire terms.
- The Hirer is responsible for the total hiring fee and the balance must be paid to the Company one month before the day of the commencement of the cruise. If a Cruiser is booked less than one month prior to the date of hire, the total hire fee must be paid on booking.
- Should the Hirer be unable to take over the craft, he must notify the Company immediately, in writing, when every effort will be made to re-let her. Should this be successful, a charge of 15% of the total hire fee will be made for the service. Should the craft not be re-let, the total hire fee is forfeited.
- Persons under 21 are not permitted to hire craft, unless a Parent or Guardian gives written consent, which must accompany booking form and deposit.
- The descriptions of the craft in the brochures are generally accurate although the plans of accommodation are not necessarily to scale.
- The hire period begins at 16.00 hours on day of commencement and terminates at 10.00 hours on final day of booked period. Special arrangements must be made on taking or handing over at other times. For 3 night short break and low-season cruises, flexible arrival and departure times can be arranged in advance, subject to change at the Company's discretion and subject to availability.
- Craft must be returned punctually and in a clean state. The Hirer is responsible for allowing sufficient time to permit his return by the time stated. The craft must be returned to the Marina by 09.30 a.m. on the final day of hire period. Breach of this condition entails a further fee equal to twice the daily hire rate for every day or part of a day until delivery is effected and the making good to the Company of any losses sustained.
- The Company will demonstrate the Cruiser handling techniques by means of an accompanied trial run on the hired Cruiser together with detailed instruction on navigation with the charts provided. Further information or instruction may be requested by the Hirer. Acceptance of the trial run is the Hirer's Agreement of competence to captain the Cruiser, in compliance with the Shannon Navigation Bye-Laws, and to accept responsibility for the Cruiser and its contents. The Company reserves the right to refuse to hand over a craft to any person who in the opinion of the Company representatives is not competent to handle such a craft. This safeguard is in the interest not only of the Company and of the Hirer and his party, but of others who use the waterways.
- Insurance of the Craft, her equipment and Third Party risks are included in the Hire Fee, except for the amount as indicated in the Price List for the refundable Damage Deposit or non-refundable Damage Insurance, which is payable by the Hirer on arrival at the marina. The Damage Deposit is refundable on completion of the cruise, if no loss or damage has been incurred and the craft has not been involved in an accident. No replacement of equipment can be accepted unless the same as the articles lost or damaged. Personal Injury is not covered by the Damage Deposit or Damage Insurance. Personal Injury Cover is assumed to have been arranged by the Hirer.
- On arrival at the Marina, the Hirer must produce the booking receipt and pay the Damage/Insurance Deposit. Payment must also be made on check-in for any provisions and extras required. Fuel used will be paid for on completion of hire period.
- Major repairs are the responsibility of the Company even if made necessary by the negligence of the Hirer. The Company must be notified immediately if any repairs become necessary. No repairs or adjustments may be made by other firms without authority.
- The Company will take all reasonable care to ensure that the craft is handed over in good order and clean condition. In the unlikely situation that this is not to the Hirer's satisfaction, the Management must be notified before commencement of the cruise, and the matter will be rectified immediately, as complaints made afterwards cannot be recognised. The Company will not be responsible for non-fulfilment of programme, consequent damages or delays due to breakdown, other defects or unforeseen causes. The Company also cannot be held responsible for delays and restrictions of Cruising Waters due to repairs or damage or navigational works or floods, etc. No financial adjustments can be made in the circumstances. Nor can the Company be held responsible in any way for loss overboard of personal possessions.
- Craft may not be taken in Tidal Waters or below Killaloe Bridge and must not be navigated after sunset or before sunrise. Craft must be moored alongside and must not be left on anchor at night. Speeds must be such as to cause no inconvenience or danger to other users of the waterways.
- The Hirer is responsible for the safe navigation of the craft. In the event of a mishap the Hirer must furnish the Company immediately with full particulars and names and addresses of witnesses.
- Where Hirer's motor cars are parked or property stored on the Company's premises the Company accepts no liability for loss or damage caused by Theft, Fire, Flood, Accident etc. Insurance cover is assumed to have been provided by the owner. We reserve the right to alter tariffs, conditions and craft at our own discretion.
- Should unforeseen circumstances arise, the Company reserves the right to substitute craft at any time for those illustrated in the brochure. Where the substituted craft has a smaller number of berths, the hire charge will be adjusted in accordance with our current price list, otherwise no alteration to price will be made. If owing to circumstances beyond the Company's control a craft is not available, all monies paid to the Company will be refunded and the Hirer will have no claim on the Company.
- Bicycles are hired at client's risk, and the Company will accept no responsibility for the loss or injury sustained by their use. Outboard Motors should be tested to client's satisfaction before leaving the Marina at Williamstown Harbour, as we do not provide service or repair to this item outside our Marina, and no refunds or cash adjustments can be made for same at the end of the cruise. A separate damage deposit of £50 is payable on embarkation. Should the Outboard be lost or stolen, the Hirer is liable for the full replacement cost.
- Pets are not permitted aboard the craft.
- We reserve the right to alter tariffs, conditions and craft at our own discretion
